Shoot Sports Photography is a volume photography business established in Ottawa, ON - Canada. Mentioned in this document as the “Studio”.
The concept of volume photography encompasses an unspecified number of images from a specific event, that captures most, if not all, the participants involved. The studio is noncommittal in registering all of the participants due to the nature and unpredictability in sports/group events.
Anyone that purchases and downloads image products directly from the website and/or through direct contact (email, phone, etc.), considering that a payment was properly processed and products/images delivered, is considered a “Customer”.
All Customers agree with the terms in this document.
All people that have their image and likeness, or the ones they are legally responsible for, agree to the terms and conditions presented here, even if they do not buy any image or product.
All participants give their consent on having their image and likeness registered, unless explicitly requested in written not to, prior to the event. A consent email is generally submitted prior to the event. Should no one express their willingness to not having their image, or the ones they are legally responsible for, registered, it will be automatically considered as consented/approved.
In the case of no consent, the studio is committed, in good faith, to not register/shoot the specific person, and/or remove any photos where their image and likeness is clearly depicted. Due to the nature of group sports and group events, someone might still be registered in the context of a group setting/activity and therefore their image might still be visible. The studio reserves the right to keep that image as available, considering this is not done in bad faith or represents damages to the person in question, without any liability for the studio or any monetary compensation owned by the studio.
Images are intellectual property of the studio. Images are hosted on the studio website and will be retained for an unspecified period of time, and can/will be destroyed/deleted at any time, without prior notice and any liability for the studio.
The images are for the sole purpose of commercialization between the studio and the people directly involved with the event in question (e.g. families and people related to participants, who authorized their images to be registered and commercialized through the studio’s website)
The images bought by the customers are for personal use only and cannot be commercialized/re-sold without the studio’s knowledge and consent, as images are intellectual property of the studio. Any commercial use of the images constitutes in royalties and IP owned to the studio.
Images and products where a download link was provided are not eligible for a refund.
In the case of an image and/or product to be faulty, digitally corrupted or not up to the technical specifications described on the initial order that prevents the customer to utilize the image, the studio commits to replace, re-send a proper image/file. A refund might be issued if the problem persists or cannot be resolved by the studio within a reasonable amount of time.
The studio is committed to share the images only with the related team/organization and families related/authorized to/by them, through a password-protected gallery. This does not prevent the unsolicited sharing and access of the gallery by third party entities, without any responsibility and/or liability for the Studio. Reasonable measures to prevent/mitigate the improper access to the images are in place, and any possible breach does not constitute in legal liability to the studio.
The studio is authorized to commercialize the images, without any royalties and additional rights for the use of image owned to the people portrayed. The people portrayed give up any image rights or monetary compensation for the use of the image and likeness, for an unspecified period of time, unless they have specifically requested to not be portrayed (see authorization clause above).
The Studio reserves the right to utilize images for promotional and portfolio purposes, without any monetary compensation or image rights owned to the people portrayed. In the case of someone being portrayed on one of the promotional materials, the studio is willing to, in good faith, review and if deemed necessary, remove the image in question, without any liability, penalties, monetary compensation owned to the person in question, as images are intellectual property of the studio.
The studio commits to not alter the image and likeness of any person depicted, by digital means, in a way that defames, embarrass, deforms, or portrays the person in a disrespectful / shameful way and/or situation. It is our core value to preserve an respect the integrity and dignity of all people depicted/photographed.
The studio commits not to share, purposefully, the images (whole or parts of it) with third party entities for criminal, unauthorized or suspicious activities. This does not constitute in any liability of the studio should images are utilized, without the studio’s knowledge and consent by bad actors for the above intentions.
The studio abides and follows all federal, provincial and municipal rules and regulations that oversee the photography activity and the commercialization of photographies/images and creative work. All and any circumstance not covered in this document are subjected to those rules.
